What Pecan Village's governing documents say
Pecan Village is a single-family home subdivision in Joshua, TX, governed by this Declaration of Covenants, Conditions, and Restrictions (CC&Rs). These rules apply to all lot owners and are designed to maintain a residential character with minimum home size standards, architectural controls, and prohibitions on nuisances and commercial activities.
- Minimum home size: Any residence must have at least 715 square feet of floor space, excluding porches and garages.
- Prohibited uses: No business or commercial activity without prior approval from the Architectural Control Committee. Mining, junk yards, storage/sale of used vehicles, and keeping swine are also prohibited. Animals cannot be kept for commercial purposes or in a manner that is a nuisance.
- Architectural review: All construction, placement, or alteration of buildings and other structures (including moved structures) require prior approval from the Architectural Control Committee, which reviews plans for quality, design harmony, and location. The Committee initially consists of the original developers, but a majority of lot owners can change its membership or powers.
- Yard maintenance: All yards must be kept mowed, with grass never exceeding 6 inches in height. Lots must be kept free of trash and debris, and no offensive or annoying activities are permitted.
- Vehicles and parking: No unlicensed, uninspected, or inoperable vehicles may be kept on the property. Wrecking yards are prohibited.
- Setbacks and building location: Buildings must be located at least at the building setback line shown on the recorded plat, and no closer than 10 feet to a side lot line.
- Term and amendments: These restrictions are binding for 35 years from the date of the document (August 1988), and automatically renew for successive 10-year periods unless modified or released by a recorded instrument executed by a majority of lot owners.
- Enforcement: The covenants may be enforced by the Architectural Control Committee or by any lot owner through legal proceedings. Invalidating one restriction does not affect the others.
