- Warranty limitations: The only express warranty from builder is the written limited home warranty. Owner waives all implied warranties (e.g., good and workmanlike construction) and agrees that the limited warranty replaces them.
- Mold liability: Builder disclaims all liability for mold, mildew, fungi, or other biological impurities. Owner releases builder from any claims related to such substances and is responsible for maintenance and prevention.
- Builder's repurchase right: If the reasonable cost to repair a construction defect exceeds 20% of the improvements' current fair market value (excluding the defect), builder may elect to repurchase the property under Texas Property Code §27.004.
- Manufacturer warranties: Warranties on appliances, HVAC, and other equipment are assigned to the owner. Builder makes no warranties on those items and disclaims implied warranties of merchantability and fitness.
