What Harper's Glen HOA's governing documents say
Harper's Glen is a single-family home HOA in Keller, TX. This declaration of covenants, conditions, and restrictions (CC&Rs) is the full rulebook for homeowners, covering everything from dues and architectural approvals to how you can use your property and what you can build. It's binding on all lot owners, and the HOA enforces it.
- Homeowners association & voting: Every lot owner is automatically a member of the Harper’s Glen HOA and gets one vote per lot owned. The Declarant (developer) has a special Class C membership with 6 votes per lot it owns and controls the association until January 1, 2013, or until it no longer owns any lots, whichever comes first.
- Assessments & fees: The maximum regular annual assessment is $500 per lot, and it can be raised up to 30% above that with member approval. Late fees are $25 per month for Class A members (half for builders) and there's a service charge for returned checks. Special assessments for capital improvements need affirmative member approval. Unpaid assessments become a lien on the property.
- Architectural control: Any building, fence, or other improvement requires written approval from an Architectural Control Committee appointed by the Declarant. Plans and specifications must be submitted, and the committee has 30 days to approve or deny. Variances can be requested. The committee has broad discretion over design, materials, and placement.
- Home construction & standards: Only single-family homes are allowed. Minimum living area is 2,800 square feet total (2,200 sq ft for 1.5-story, 1,800 sq ft ground floor for two-story). Exterior materials must be at least 80% brick, stone, or stucco on the first story. Roofs must meet minimum standards (e.g., slate, tile, or 30-year composition shingles). Homes must be completed within 12 months of starting construction or the developer can fine you $100 per day.
- Use & maintenance restrictions: Lots are for residential use only. You must maintain your property (mow, clean, etc.) or the HOA can do it and charge you up to $500 per occurrence. Noxious or offensive activities, animals (except dogs and other household pets), and commercial pet breeding are prohibited. You can't have more than 4 household pets per lot.
- Vehicles & parking: No trucks over 3/4 ton, boats, trailers, mobile homes, or other vehicles (except passenger cars) may be parked overnight on streets or in driveways unless hidden from view. Vehicles with flammable or explosive cargo are prohibited. Trailers left in the street for more than 48 hours may be towed.
- Other property rules: Fences must be approved and are limited in height (max 8 feet) and materials (no chain link visible; wrought iron for street-facing sections). No aboveground pools. All utility lines must be underground. Solar panels visible from the street are prohibited. Signs are limited (e.g., one 'for sale' sign up to 12 sq ft). Outdoor clothes drying visible to the public is banned.
