What Tuscany Keller Homeowners Association, Inc.'s governing documents say
Tuscany Keller Homeowners Association, Inc. is a standard single-family-home HOA in Keller, TX. This document set contains various policies, bylaws, and a supplement to the governing documents, but does not include the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs). It is intended for homeowners and prospective buyers to understand specific rules and procedures, especially those required by Texas law, but many core rules (e.g., assessments, maintenance obligations, use restrictions) are not covered here.
- Working capital fund for new owners: A $1,000 mandatory, non-refundable contribution to the Association's working capital fund is collected at each lot closing to a new owner (builders buying from developer not exempt). The fund covers operating expense shortfalls.
- Document inspection & copying fees: Owners may request records in writing; standard copies cost $0.10 per page. Labor charges ($15/hr) apply for requests over 50 pages or requiring programming ($28.50/hr). Overhead of 20% on labor may be added. Prepayment may be required.
- Alternate payment plans for delinquent accounts: Owners may enter a payment plan of 3 to 18 months to pay delinquent balances. Only the owner of record can apply. A previous default disqualifies a new plan for 2 years. A fee may be charged to establish and administer the plan.
- Religious item display: Owners may display religious items on the entry door or door frame, but total size cannot exceed 25 square inches. Items must not threaten health/safety, violate law, or be patently offensive. They must not extend past the outer edge of the door frame.
- Solar energy devices: Solar devices require prior ACC approval. They may only be installed on the roof (within roofline, parallel to slope, with frame in silver/bronze/black) or in a fenced yard/patio (not taller than fence). Cannot be located on common property. Exceptions may be made if a designated area reduces energy production by more than 10%.
- Flag display: Owners may display U.S., Texas, or armed forces flags. Flagpoles must be permanent materials, max 20 feet tall, with minimal halyard noise. Only one flagpole per lot, flag max 4x6 feet. Lights must not be a nuisance. Prior ACC approval required.
- Roofing materials: The Association cannot prohibit shingles that are wind/hail resistant, provide greater energy efficiency, or enable solar generation, as long as they resemble surrounding shingles, are durable, and match aesthetics. Prior ACC approval required.
- Rainwater collection devices: Rain barrels and harvesting systems require ACC approval. They cannot be placed in the front yard (between home and street) or on common property. Color must match home's color scheme. Must not cause drainage problems. Restrictions must allow economical installation.
