What Lakes of Marshall Ridge's governing documents say
Lakes of Marshall Ridge is a single-family home HOA in Westlake, TX. This document is a set of supplemental policies and rules adopted in 2022 to comply with new Texas laws, amending the existing HOA rules. It is not the full set of restrictions; many core rules (e.g., pet limits, leasing rules, assessment amounts) are not included here.
- Covenant violation hearings: If you receive a violation notice, you can request a hearing within 30 days. The board must hold the hearing within 30 days of your request. You are entitled to receive all evidence at least 10 days before. Audio recording is allowed.
- Architectural review appeals: If your architectural application is denied, the denial notice must explain the basis and your right to a board hearing within 30 days. The hearing must be held within 30 days of your request. The board can affirm, modify, or reverse the denial.
- Board meeting notice requirements: Regular board meetings: notice by mail 10-60 days in advance, or posted/emailed at least 144 hours before. Special meetings: notice by mail 10-60 days, or posted/emailed 72 hours before. Certain actions (fines, assessment increases, foreclosure, budget approval) require an open, noticed meeting.
- Service contract bid procedures: For contracts over $50,000, the association must solicit bids. It must request bids from at least three vendors, with at least 7 days to respond. If only one bid is received, that bid may be accepted.
- Pool fencing and security measures: Pool enclosures must be approved. The association cannot deny a black, transparent mesh enclosure up to 6 feet that meets safety codes. Security measures (cameras, motion detectors, fencing) also need approval. Front yard security fencing is discouraged; if installed, it must be black ornamental metal with specific dimensions.
- Delinquent assessment notice and cure period: Before reporting delinquency to credit bureaus or charging collection fees, the association must send a certified letter giving at least 45 days to cure. The letter must detail the amount and options for a payment plan. Credit reporting also requires 30 business days' notice.
- Religious display policy: Owners may display religious items motivated by sincere belief, subject to restrictions: no threat to health/safety, no violation of law, no patently offensive content. Items cannot be on common property, building lines, or attached to traffic devices. The association may remove violative items.
- What this document doesn't cover: This supplement does not contain the full rules. It omits core covenants such as pet limits, leasing restrictions (e.g., minimum lease terms), assessment amounts, parking rules, and other common HOA regulations. Readers must consult the recorded Declaration of Covenants, Conditions and Restrictions for those details.
