What Foxborough Homeowners''s governing documents say
Foxborough is a standard single-family HOA in Southlake, TX—you own your lot and home in fee simple, and the association maintains common areas and enforces uniform rules through assessments. The rules bind all lot owners, prospective buyers, and renters. This document is the full Declaration of Covenants and Restrictions (1998) with a 1998 Supplemental Declaration clarifying garage requirements.
- What you own & maintain: You own your lot and residence in fee simple; the association maintains designated common areas (e.g., trails, landscaping, perimeter fences) and carries no master insurance (not mentioned). Each owner must maintain their own building, yard, and utility lines from residence to main lines.
- Architectural review (ACC): All exterior construction, alterations, fences, walls, signs, and landscaping must be approved in writing by the Architectural Control Committee (ACC). Plans must be submitted at least 10 days before construction; ACC has 30 days to respond or approval is deemed given. Approval can be denied for disharmony with surroundings, incomplete plans, or noncompliance with covenants.
- Use restrictions: No business, trade, or profession allowed. Minimum floor space varies by lot: 2,800–3,200 sq ft depending on block and lot. Maximum building height: 2 stories or 36 feet. Roofs must have minimum 8/12 pitch (unless ACC approves otherwise). At least 80% of exterior walls must be stone or masonry. No open fires or incinerators; no antennas, towers, or satellite dishes without ACC approval. No noxious activities or unsightly conditions.
- Garages & parking: Garages must be side entry or rear entry (cannot face a street). A three-car garage may have a single door facing the street if set back at least 20 feet behind the front building line and the two-car portion faces at least 90° to any street. Garages must provide space for at least two cars. No storage of boats, campers, trailers, or inoperable vehicles visible from street without ACC approval.
- Fencing: Fences must be approved by ACC; specific lots have required wrought iron or board-on-board fencing (heights 4–8 ft, as shown in exhibits). Retaining walls visible from street must be brick or masonry. No fence higher than 42 inches in front yards unless ACC approves. Specific fencing restrictions for lots adjacent to common areas or certain blocks (see Exhibits C & D).
- Leasing & rentals: Owners may lease or rent the entire lot and residence only (no partial leasing). All leases are subject to all provisions of this Declaration. No minimum lease term is stated, but the lease must comply with all restrictions.
- Pets: No animals, livestock, or poultry may be kept except dogs, cats, birds, or fish, subject to ACC approval if the pet becomes a nuisance. No specific numeric limit is stated.
- Assessments & fees: Annual assessments are established by the Board: initially capped at $500 per year (in 1998), adjustable by board without owner vote. Special assessments may be levied for non‑recurring expenses. Unpaid assessments become a lien on the lot, enforceable by foreclosure, with 18% annual interest (or max legal rate) and attorney fees.
