It allows pedestrian and vehicular access and utility use. No buildings, fences, or barriers may be erected that would block traffic or interfere with the easement.
- Driveway construction & maintenance: The owner of Lot 1 must build a concrete driveway within the easement at their own cost, following city specs. After construction, each lot owner maintains the portion of the driveway on their own lot. Any damage caused by an owner or their visitors must be repaired by that owner.
- Default & liens: If an owner fails to meet their obligations under the easement declaration for 30 days after written notice, another affected owner can step in to fix the problem. The defaulting owner must reimburse the cost plus 10% annual interest, and the obligation is secured by a lien on the lot, subject to any mortgages.
