Fern Oak Addition is a single-family home subdivision in Mansfield, TX, governed by a Declaration of Covenants and Restrictions that run with the land for an initial 30-year term (from 2000) and automatically extend. These rules bind all current and future homeowners and are enforceable by any lot owner.
- Residential use only: Lots may be used exclusively for single-family residential purposes. No business, hospital, or commercial activity is allowed, though the declarant retains rights for sales and construction trailers during the development period.
- Architectural review: An Architectural Control Committee (ACC) must approve exterior paint, fencing, storage buildings, and any new structures. All outdoor storage buildings must be of like materials as the primary dwelling, with the same percentage of masonry. The ACC may consider hardship or good planning for variances.
- Parking & vehicles: All vehicles must be parked behind the front property line. No street parking overnight. No mobile homes, trailers, boats, or RVs may be used as a residence. Boats and RVs may be stored only if housed behind a solid fence out of view from the street and adjoining lots.
- Landscaping & maintenance: Owners must plant at least one tree per lot (minimum 2-inch trunk). No weeds, unsightly growth, or refuse piles are allowed. Underground utility and drainage easements are reserved; owners maintain their lot improvements except for public utility infrastructure.
- Fences & sight lines: Fences may not exceed 6 feet in height and are subject to ACC approval. Corner lots have sight-line restrictions: no fence, hedge, or shrub between 2 and 6 feet above road within a triangular area (20 feet from street property lines intersection) or within 10 feet of driveway/alley. Masonry mailboxes are preferred.
- Temporary structures & outbuildings: No temporary structure (tent, shack, barn, mobile home) may be used as a residence. Temporary buildings allowed only during construction and must be removed upon completion. No motor homes, trailers, or tents as dwellings.
- Enforcement & duration: Covenants run for 30 years from recording (2000) and auto-renew for 10 years unless owners vote to change. Invalidation of one provision does not affect others. Failure to enforce does not waive future enforcement.
