This is a restrictive covenant recorded for a specific lot (900 Royal Court) in Queensgate, binding on current and future owners. It is not a community rulebook but a builder-imposed agreement that runs with the land, mandating mediation/arbitration for disputes, limiting warranties, disclaiming liability for mold, and releasing the builder from most claims. The reader is a current or future owner of that lot.
- Dispute resolution: All disputes (contract, warranty, tort, etc.) must first go to mediation; if not settled, they go to binding arbitration under the Federal Arbitration Act. Filing a lawsuit is a waiver violation and the party may have to pay the other's costs and fees.
- Warranties: The only express warranty is the builder's written limited home warranty. All implied warranties (e.g., good and workmanlike construction) are waived and replaced by that limited warranty. Manufacturer warranties on appliances are assigned to the owner.
- Mold and biological impurities: The builder disclaims all liability for mold, mildew, fungus, etc. The owner releases the builder from any claims related to these, including personal injury. The owner is responsible for maintenance to prevent mold.
- Release and acceptance: By signing, the owner acknowledges the improvements are complete and accepted, releasing the builder from all claims except those under the limited warranty. This release survives closing.
