- Dispute resolution & arbitration: Any dispute (contract, warranty, tort, personal injury) with the builder must first go through mediation, and if unresolved, binding arbitration under the Federal Arbitration Act. The arbitrator can award costs and fees to the prevailing party. Filing a lawsuit is not allowed unless to compel arbitration.
- Warranty & liability: The only express warranty from the builder is a separate limited home warranty. By signing, the owner waives any implied warranty of good and workmanlike construction to the extent allowed by Texas law. If repair costs exceed 20% of the property's fair market value, the builder may repurchase the property.
- Mold & biological impurities: The builder disclaims all liability for mold, mildew, spores, or other biological impurities. The owner assumes responsibility for maintenance to prevent mold and releases the builder from any claims, including personal injury, related to mold. This includes a waiver of subrogation rights.
