This is not a community rulebook — it is a set of individual lot-level 'Restrictive Covenant and Agreement' documents between the original builder (Bloomfield Homes) and the first owner of each home in Remington Ranch (a standard single-family HOA in Mansfield, TX). These documents were recorded and 'run with the land,' meaning they bind all future owners of those specific lots. They cover dispute resolution, warranties, and mold liability, but they do not contain the HOA's own governing rules (like architectural standards, parking restrictions, or assessments).
- Dispute resolution: mandatory mediation & arbitration: Any dispute between owner and builder — including claims about construction, warranties, or personal injury on the property — must first go to mediation, then to binding arbitration under the Federal Arbitration Act. Filing a lawsuit is a violation of the agreement and the filing party must pay the other side's costs and attorney fees. A court can still order arbitration even if a lawsuit is filed.
- Limited warranty replaces implied warranties: The only express warranty is the builder's written Limited Warranty. By signing, the owner waives any implied warranty of good and workmanlike construction (to the extent it exists in Texas). The Limited Warranty sets the sole construction standards. Owners must deliver a copy of the Limited Warranty to any future buyer.
- Builder's right to repurchase for major defects: If the cost to repair a construction defect that is the builder's responsibility exceeds 20% of the improvements' current fair market value (without the defect), the builder may elect to repurchase the property under Texas Property Code Section 27.004. This right binds future owners.
- Mold and biological impurities – disclaimer and release: The builder disclaims all liability for mold, mildew, fungus, or other biological impurities. The owner releases the builder from all claims (including personal injury) related to mold or chemicals on the property. Owners are responsible for maintenance to prevent mold, and must obtain waivers of subrogation from their insurers.
- Manufacturer warranties assigned to owner; no builder warranty on appliances: All manufacturer warranties on appliances, HVAC, water heaters, etc., are assigned to the owner. The builder makes no warranty on those items and disclaims any implied warranties of merchantability or fitness for a particular purpose.
