Chancellor Creek is a single-family residential subdivision in McKinney, TX, governed by a Declaration of Covenants, Conditions and Restrictions (CCRs). The document applies to lot owners, not unit owners; there is no homeowners association — architectural control is handled by a committee. The CCRs regulate building design, setbacks, drainage, and landscaping to maintain a uniform community appearance.
- No formal HOA: The declaration explicitly states that no homeowners association is established. Architectural control is exercised by a committee composed of lot owners (initially the declarant).
- Architectural review: All construction, landscaping, and exterior alterations require approval from the Architectural Control Committee. Mailboxes must be brick, stone, or masonry; fireplace chimneys must be brick or stone (or approved material). Trees newly planted must have a minimum 3-inch caliper and be of approved species (Live Oak, Red Oak, etc.).
- Setbacks & improvements: Minimum setbacks are specified by lot: front 25 feet (some lots 30 feet), rear 20 feet, side yard 10% of lot width but not less than 20 feet on street side. Eaves, steps, and open porches are not considered part of the building for setback purposes. No building may encroach on another lot.
- Minimum square footage: Originally, the main residence required a minimum air-conditioned living area of 3,000 square feet for lots over one acre and 2,400 square feet for others. However, the First Amendment (2002) deleted this entire section, so there is currently no minimum square footage requirement under the CCRs.
- Drainage & retaining walls: Lots must be graded per an approved drainage plan. No lot may drain onto another except directly into a creekbed. Owners must install and maintain retaining walls along property lines on the 'high side' of the lot, as determined by the Architectural Control Committee.
- Enforcement & amendments: The CCRs may be amended by more than 60% of lot owners (one vote per lot). The declaration is binding on all owners, successors, and assigns. Failure to enforce any covenant does not waive future enforcement rights.
- What this document doesn't cover: This document does not address pet restrictions, rental or leasing rules, parking, age restrictions, or any use limitations beyond lot use as residential. It also does not create a mandatory homeowners association or set common area maintenance obligations.
