It is NOT a homeowner or condominium association governing document — it does not contain rules for residents. Instead, it outlines the developer's obligations for constructing water, sewer, and road infrastructure, and for conveying certain remnant parcels to the developer. Homeowners, buyers, and renters should look to a separate HOA declaration or CC&Rs for community rules.
- What this document covers: The document is a facilities agreement that requires the developer to build public improvements (water mains, sewer lines, collector streets, a gate, etc.) and to transfer certain small parcels of land to the developer. It also assigns developer rights from one entity to another.
- Infrastructure & improvements: The developer must construct water mains, sanitary sewer lines, the 'Collector Street' (connecting State Highway 5 to the northern property line), a Cardinal Drive extension, a County Road 365 reroute, and off-site sewer mains, all at the developer's cost and subject to City approval.
- Security gate: The developer must install an electric gate substantially similar to the existing Country Ridge gate on US Highway 75, constructed simultaneously with a connection from Country Ridge to Surrey Drive.
- Property conveyance (Remnant Parcels): In exchange for building the Collector Street extension, the City will convey to the developer small irregularly shaped parcels (the 'Remnant Parcels') that cannot be used independently, including parcels near Owens Ranches and Country Ridge well sites.
- What this document doesn't cover: This document does not contain any rules for homeowners, such as pet restrictions, leasing limits, architectural standards, parking rules, or any other resident obligations.
