Willow Grove is a rural subdivision in Lamar County, Alabama, governed by a Declaration of Covenants and Reservations filed by the developer, Classic Country Land, LLC. There is no homeowners association; the covenants run with the land and are binding on all parcel owners until October 3, 2053 (with automatic 10-year extensions unless changed by two-thirds of owners by land area). These rules apply to anyone who owns or lives on a parcel.
- Land use & dwelling types: Parcels are for single-family residential and recreational use only; no commercial activity (including commercial marijuana growing). One greenhouse up to 200 sq ft is allowed. Permitted dwellings include conventional buildings, portable buildings, tiny homes, and travel trailers/RVs/portable cabins/campers. No tents or lean-tos as residences. Only one dwelling per 5 acres. Temporary recreational structures may remain no more than 21 days per calendar year.
- Leasing & subleasing: Subleasing is prohibited during the term of the Contract for Deed. After the contract is paid, the covenant does not explicitly restrict leasing, but the general restriction on commercial use applies. Owners may not rent, lease, sublet, loan, or assign any part of the property while under contract.
- Pets & livestock: No more than three dogs per contract for deed; dogs must be kept on your property. Farm animals (horses, cattle) are permitted if the parcel is fenced and no nuisance or stream contamination occurs. Swine are not allowed for commercial purposes. No stockyards or other commercial animal operations.
- Waste, debris & environment: No refuse, derelict vehicles, inoperable machinery, old tires, or unused building materials. Waste must be in closed containers. Burying or dumping garbage/liquids/littering is prohibited. Violations must be corrected within 30 days of notice, with a $100/week fine thereafter. Natural streams or springs may not be dammed or re-routed. No foreign substances into waters.
- Timber & cutting: No cutting or removing marketable timber (stump diameter 16" or larger, measured 6" from ground) without written permission from Classic Country Land, LLC during the term of indebtedness. Permitted only for dead/dying trees, or clearing for building sites, roads, fire prevention, utilities, view corridors, or recreational open space. No more than 20% of any parcel may be cleared. Cut timber may not be sold. Violation penalty: at least $1,000 per tree.
- Roads & setbacks: Owners are responsible for maintenance of private access roads. No commercial vehicles or heavy equipment on roads unless for construction; any damage must be repaired by the responsible party. Delivery trucks allowed. Structures must be set back at least 70 feet from access roads and 50 feet from boundaries. Fences must not encroach on road easements.
- Subdivision of parcels: No parcel may be subdivided into more than 2 parcels without written consent of the Seller. Subdivision is prohibited until the Contract for Deed is paid in full and ownership conveyed.
- Hunting & recreation: Hunting of any kind is prohibited on or from any access road within the property. Owners must follow state wildlife regulations.
