What Manors at Woodbridge Homeowners Association, Inc.'s governing documents say
Manors at Woodbridge is a single-family home homeowners association (HOA) in Murphy, TX. This recorded document contains the association's Fine & Enforcement Policy and Assessment Collection Policy — it does not include the full declaration of covenants, conditions, and restrictions (CC&Rs). It is relevant to homeowners (owners) and tells you how fines and delinquent assessments are handled, but does not set basic use rules like pets, parking, or architectural standards.
- Fines & enforcement: Fines start at $50 for first notice, escalating to $125 by fourth notice for general violations (e.g., unsightly conditions, unauthorized construction). Fines for continuing violations may be levied daily, monthly, or quarterly at the Board's discretion. The Association cannot foreclose a lien based solely on fines.
- Violation notice & hearing: Before a fine is levied, the Association sends a written Violation Notice via certified mail describing the violation, cure timeframe, possible fine, and hearing rights. The owner may request a hearing within 30 days; the Board must hold it within 30 days of receipt. If the owner received a notice for the same violation in the prior 6 months, no additional notice or hearing is required.
- Assessment collection & late fees: Assessments not paid by the due date are delinquent. The Association may charge a late fee of $25 per month and interest at up to 1.5% per month (or highest lawful rate). A returned check fee of up to $50 may apply. Payments are applied first to oldest delinquent assessments, then current assessments, then attorney's fees, fines, etc.
- Delinquency notices & lien: For delinquent accounts, the Association must send at least two notices before recording a lien — the first by email or first-class mail, the second by certified mail at least 30 days later. The Association may report delinquencies to credit bureaus and pursue foreclosure only upon a majority Board vote.
- Transfer & resale fees: The Management Certificate lists fees: Resale Certificate $375.00, Transfer Fee $250.00, Optional Inspection Fee $150.00, Working Capital $450.00. These are charged upon property transfer.
- Payment plans: If an owner requests a payment plan in writing before receiving a delinquency notice, the Association must offer a plan of at least two years. Otherwise, the Association is not required to offer a plan.
- What this document doesn't cover: This document does not include the full CC&Rs or any rules about pets, leasing, parking, architectural standards, or age restrictions. Those are governed by the separately recorded Declaration of Covenants, Conditions, and Restrictions.
