What Crestpoint Homeowners's governing documents say
Crest Point Addition is a single-family home subdivision in Pantego, TX governed by a homeowners association (Crestpoint Homeowners Association, Inc.). These amended restrictions apply to all lot owners and set rules for land use, construction, maintenance, and assessments. Key requirements include minimum lot size, minimum dwelling size, exterior materials, setbacks, and architectural approval.
- Lot & dwelling requirements: Each lot must be at least 20,000 sq ft. Only one single-family residence per lot, minimum 1,800 sq ft heated area (excludes garage, porches). The exterior (excluding roofs, windows, doors) must be at least 50% brick, stone, or stucco. Roofs cannot be composition asphalt shingles. Dwellings must be completed before occupancy; no garage or outbuilding used as residence.
- Setbacks & building lines: No structure within 20 ft of front property line, within 5 ft of side lot line. Dwelling width (including porches, attached garages) cannot exceed 80% of lot width at building line. Waterfront lots (abutting Eagle Mountain Lake) have a 50-ft no-build zone from the property line.
- Architectural review: No buildings, fences, walls, or other structures may be constructed or altered without prior written approval from the Architectural Control Committee (ACC). Plans must include a letter, detailed drawings, and a plot plan. ACC cannot approve plans that don't meet requirements or if other unapproved construction exists on the same lot.
- Assessments & liens: The association levies annual and special assessments, uniform per lot. Annual assessments set by the Board; special assessments require majority member vote. Assessments create a lien on the lot (subordinate to mortgages) and are a personal obligation of the owner at the time due. Delinquent assessments accrue 18% interest plus collection costs.
- Common properties & membership: Common properties include roads, berms, and security fence, owned by the association. Each lot owner is a member with one vote per lot. Members have an easement to use common properties, but the association can regulate use, borrow against them, or dedicate them to public entities with member approval.
- Use restrictions: Only single-family residential use. No noxious or offensive activities. No billboards or advertising signs; 'For Sale' or 'For Rent' signs limited to 36x24 inches. No poultry, swine, rabbits, cows, horses, or other livestock; dogs, cats, or household pets allowed but not for commercial purposes. No drilling for oil/gas or mining. No radio/TV towers or aerials except small satellite dishes (≤1 meter). No relocated buildings from outside the addition.
- Duration & amendments: These restrictions automatically extend for successive 10-year periods. They can be abolished by 75% of votes (recorded one year in advance) or amended by majority of fee owners during the final year of any term. The document is a restatement adopted in 2002.
