What Ranch at Eagle Mountain Four's governing documents say
These are individual Restrictive Covenant Agreements recorded for specific lots in The Ranch at Eagle Mountain Four subdivision (Pelican Bay, TX). They were signed between the original lot owner and the builder (McBee Homes / Sutter Homes / Mearstone Properties) and run with the land for that lot. They do not constitute a full set of community rules, CC&Rs, or HOA governing documents.
- Dispute resolution: All construction-related disputes must go through mediation first, then binding arbitration under the Federal Arbitration Act. The arbitrator decides arbitrability and can award attorney's fees.
- Warranties: All implied warranties (habitability, workmanlike construction, etc.) are disclaimed to the fullest extent allowed by law. If not disclaimable, they are limited to 2 years from the date the builder conveyed the property.
- Mold and biological impurities: The builder disclaims all liability and warranties for mold, mildew, fungus, spores, or other biological impurities. The owner releases the builder from all claims, including personal injury and property damage, and agrees to obtain waivers of subrogation from insurers.
- What this document doesn't cover: This document does not address typical HOA rules such as pet restrictions, leasing, parking, architectural review, assessments, or common area maintenance. Those would be found in separate CC&Rs or association documents for the subdivision.
