What Biltmore Swim & Racquet Club Patio's governing documents say
Biltmore Swim & Racquet Club Patio Association is a homeowners association (HOA) in Plano, TX, likely for single-family or patio homes. These recorded policies supplement the full governing documents and cover specific operational rules: flag display and flagpole installation, assessment collection, covenant enforcement and fines, records retention, and contractor bid requirements.
- Flag display & flagpoles: An owner may install a freestanding flagpole only after obtaining Architectural Control Committee (ACC) approval; flagpoles on common area require Board approval. The flag must be displayed in accordance with U.S. and Texas flag codes, maintained in good condition, and any external halyard must be secured to reduce noise. Illumination is limited to one low-beam halogen landscaping light not aimed at neighboring property.
- Assessment payments & delinquency: Regular assessments are due monthly on the first of the month. Delinquent accounts incur late fees and interest; the Association may accelerate the balance of a special assessment after 15 days' notice. If an account is delinquent for at least 30 days, the Board may suspend the owner's (or tenant's) use of common area amenities. Payments are applied first to oldest delinquent assessments, then current assessments, attorney fees, fines, and other charges.
- Covenant enforcement & fines: The Association has adopted a Covenant Enforcement Policy and Fining Schedule (attached as Exhibit A, but the text is not readable). This policy replaces an earlier 2012 version and outlines how violations are enforced and fines levied.
- Bid process for service contracts: Service contracts with an initial term cost over $50,000 require a bidding process. The Association must solicit at least three bids (or explain why fewer were considered). The Board is not required to accept the lowest bid. Emergencies are exempt from the bidding requirement.
- What this document doesn't cover: These are supplemental policies, not the full CC&Rs. They do not cover pet limits, leasing restrictions, age restrictions, parking rules, or HOA fees amounts. Refer to the main governing documents for those rules.
