This document is a collection policy adopted by the Heatherwood (McKinney) Homeowners Association in Plano, TX. - Assessment due dates and delinquency: Assessments are due on a date set by the Board; if not paid by 5:00 p.m. on the 30th day after that date, they become delinquent. Late fees and other charges may apply.
- Returned check fees: The Association may charge a fee of at least $30 for any returned check. If two or more checks are returned unpaid within 12 months, the Association may require certified check or money order for all payments for one year.
- Lock box payments: Payments sent to a lock box are deposited without regard to any accompanying communication, dispute, or restrictive endorsement. A payment sent with a condition less than full payment is not binding on the Association unless accepted.
- Collection steps: The Association follows a sequence: (1) Reminder Statement of Account mailed after delinquency, with a second notice via certified mail after 15 days; (2) Attorney Demand Letter no earlier than 30 days after the second notice; (3) Notice of Assessment Lien filed with the county; and (4) Foreclosure proceedings (expedited or judicial) as approved by the Board.
- Payment plans: Payment plans are available for delinquent owners. The minimum term is 3 months, maximum 12 months, with equal payments. All violations must be resolved before entering a plan. Default reinstates collection steps and accrued fees.
- Fee waiver requests: Owners may request a waiver of fees, but only one waiver per 24-month period is considered. More than one request in that period will be denied.
- Suspension of privileges: If an owner fails to request a hearing or resolve a matter after a notice, the Association may suspend the owner's right to use amenities such as the pool, community center, and pavilion, and to participate in events.
