Prosper Falls is a single-family home planned community in Prosper, TX, governed by a homeowners' association. Residents own their lot and home; the HOA enforces rules and maintains common areas (if any) but is not obligated to provide amenities. The rules bind all lot owners and their tenants.
- Residential use: Lots may have only one detached single-family residence, no more than two stories, used exclusively as a single housekeeping unit occupied by a family or similar household. Commercial use is prohibited except small home offices.
- Leasing & rentals: Leases must be for at least six months. Owners must provide a written lease to the association, require tenants to carry renters insurance, and ensure tenants follow all rules. Owners are responsible for tenant violations and fines. The Board may limit the number of rentals or homes any one owner can lease.
- Architectural review: All exterior modifications require prior written approval from the Architectural Control Committee (ACC) or Declarant. Decisions may be based purely on aesthetics and are binding. Design Guidelines are attached and can be amended by Declarant without owner consent.
- Parking & vehicles: Vehicles must be parked in a garage or driveway. Commercial vehicles, RVs, boats, and trucks over one ton are not allowed to park outside. Inoperable vehicles are prohibited. The Board has discretion to set additional parking rules.
- Pets: Domestic pets (dogs, cats, etc.) are allowed as household companions but must be kept on a leash when outside a fenced area. No commercial breeding or nuisance animals. The Board may require removal of pets that constitute a nuisance or safety concern.
- Assessments & fees: All lot owners pay annual assessments (initially $550 for 2017, subject to annual increases up to 25% with a 51% membership vote). A one-time acquisition assessment of $350 is due at closing. Late payments incur a $25 late fee and 15% interest. Fines for violations up to $1,000 per occurrence can become a lien.
