It is not the full declaration of covenants; it supplements the recorded Declaration with specific rules on billing, violations, records, voting, and architectural standards for items like flags, solar panels, and landscaping. Homeowners, buyers, and renters should also review the main Declaration for complete restrictions.
- Architectural review (ARC): Many exterior changes require ARC approval, including solar panels, flagpoles, roofing materials, rainwater collection devices, and xeriscaping. Solar panels must be on rear roof unless energy production loss exceeds 10%; flagpoles limited to one per lot, max 20 ft tall, flags max 3'x5'; xeriscaping requires at least 25% of publicly visible area to be natural turf.
- Religious displays: You may display religious items on your entry door or door frame only, up to 25 square inches total, as long as they don't threaten safety or contain offensive material.
- Landscaping & natural turf: Drought-resistant landscaping (xeriscaping) is allowed with ARC approval, but at least 25% of publicly visible area must be natural turf. Non-turf ground cover (e.g., decomposed granite) is permitted; no plants with thorns within 6 ft of sidewalks; no plants over 12 inches in the sidewalk strip; hardscape items limited to 4 in public view.
- Flag display: One flagpole per lot, max 20 ft, flags limited to 3'x5'. Must abide by U.S. and Texas flag codes; need ARC approval for location and height. The American flag, Texas flag, and armed services flags are allowed.
- Solar energy devices: Solar panels require ARC approval. Panels must be placed on the rear-facing roof unless documentation shows more than 10% energy loss otherwise. They must match roof slope and color; ground-mounted panels must be below fence line.
- Rainwater collection: Rain barrels or harvesting systems must be color-consistent with the home, cannot be placed between the front of the home and the street, and must not display non-manufacturer language. ARC may regulate size, type, and screening if visible from street or neighboring lots.
- Payment plans & billing: Assessments due first day of billing period; late fees and interest may apply. Payment plans available for delinquent amounts: minimum 3 months, max 18 months, up to 12 equal installments without board vote (if eligible). Owner cannot have defaulted on a prior plan within the last 2 years. No more than one plan per 12-month period.
