Summer Place South is a residential subdivision in Arlington, TX, governed by a homeowners association (HOA). The community consists of lots with attached single-family dwellings (party walls), and all owners are automatically HOA members. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) sets the rules for what owners can and cannot do with their property.
- Property use & buildings: All lots must be used for residential purposes only. Only one attached single-family dwelling per lot, not exceeding two stories. Minimum living area is 900 square feet (exclusive of open porches, patios, etc.). Setbacks follow the recorded plat. No oil drilling, mining, or commercial activity is permitted.
- Pets: No animals, livestock, or poultry may be raised or kept for commercial purposes. Dogs, cats, and other household pets are allowed, but cannot be kept for breeding or commercial gain.
- Vehicles & parking: No trucks, buses, or trailers may be parked on the street except during construction or repair. Trucks, boats, or trailers parked on a lot must not be visible from the street.
- Signs: No signs are allowed except one real estate sign (no more than five square feet) advertising the property for sale or rent. Developers may place temporary construction or sales signs.
- Fences, trees & landscaping: Fences, walls, and hedges cannot be placed nearer to the street than the main residence, except for decorative entry fences. Shrubs and trees on corner lots must not obstruct sight lines (between 2 and 6 feet above road level) within 25 feet of intersecting streets. No structures or plantings are allowed in utility or drainage easements.
- Architectural control: No building, fence, or other improvement may be built or altered without approval of the Architectural Control Committee (ACC). Plans and specifications must be submitted; if the ACC does not approve or disapprove within 30 days, approval is deemed given.
- Party walls: Walls built on the dividing line between lots are party walls. Cost of reasonable repair and maintenance is shared in proportion to use. If a party wall is destroyed by fire or casualty, restoration cost is shared proportionally. An owner who negligently exposes a wall to the elements bears full cost of weatherproofing.
- Assessments & fees: Each lot owner must pay annual and special assessments. The maximum annual assessment initially set (amount not legible from OCR) can increase up to 5% per year without a membership vote; increases above 5% require a two-thirds vote of each class of members. Special assessments for capital improvements also require a two-thirds vote. Assessments are a lien on the property.
