This document is a Notice of Filing of Dedicatory Instruments for Stewart Peninsula Southshore Homeowners Association, Inc. in The Colony, Texas. It is a procedural filing required by Texas law that records a set of separate policy guidelines for the association. Homeowners, buyers, and residents should consult these guidelines alongside the community's main Declaration of Covenants and Restrictions.
- Religious item displays: Owners or residents may display religious items on their own property, but not on association-owned or common property, and not if the display threatens public health or safety, violates a law (other than a religious-speech law), is patently offensive for non-religious reasons, or interferes with building lines, setbacks, easements, or utility fixtures.
- Security cameras & fencing: Owners may install security cameras only on their own property — not on common areas. Perimeter fencing must comply with the association's existing size, height, color, and material rules, and requires prior architectural review and approval.
- Swimming pool enclosures: An owner may install a black, transparent-mesh-in-metal-frame pool enclosure that meets state/local safety rules. Any other design must comply with the association's existing covenants. All installations require prior architectural approval.
- Architectural review authority: The association's architectural review committee (ARC) reviews improvement requests. No current board member, their spouse, or household member may serve on the ARC. Denied applications can be appealed to the board, which must hold a hearing within 30 days of the owner's request, with detailed notice and opportunity for discussion.
- Violation hearings: Owners may request a hearing to discuss and resolve alleged rule violations. The association must provide all documents and photos it intends to use at least 10 days before the hearing. The owner (or their representative) can present their side. These procedures do not apply in certain suits or for emergency common-area suspensions.
- Contract bidding (over $50,000): The board must solicit at least three bids for service contracts over $50,000, unless an emergency or unavailability of vendors excuses it. Emergency situations include immediate risk of harm or property damage. The board does not have to choose the lowest bidder.
