Hermosa Heights is a single-family home subdivision in Anthem, AZ, governed by a homeowners' association (HOA). These covenants, conditions, and restrictions (CC&Rs) apply to all lot owners, setting rules for home construction, architecture, landscaping, pets, vehicles, and assessments. The community emphasizes a natural desert aesthetic and restricts certain activities to maintain property values and quality of life.
- Architectural review: All new structures, alterations, fences, and exterior changes require prior written approval from the Architectural Committee. Plans must include location, materials, colors, and landscaping. If no response within 30 days, approval is deemed granted unless the plan violates the Declaration.
- Minimum house size & style: Each dwelling must have a ground floor area of at least 2,500 square feet (excluding open porches, garages). Exterior style must be Spanish, Southwest Indian, or Mexican unless the Committee approves otherwise. Second stories are allowed case-by-case if neighbor privacy is not invaded.
- Landscaping & desert preservation: Desert growth shall not be destroyed except for necessary construction. Bermuda grass and allergy-producing plants are prohibited. Owners must keep lots trimmed, cultivated, and free of trash. The HOA may perform maintenance at owner expense if neglected.
- Animals & horses: Horses are allowed only on Lots 1 through 4, with a maximum of 4 horses per lot. Corrals must be pipe fencing, not in front yards, and at least 200 feet from adjacent homes, guesthouses, or pools. Other livestock or poultry are prohibited; dogs and cats are permitted in reasonable numbers (determined by HOA).
- Vehicles & parking: No mobile homes, trailers, or recreational vehicles may be stored visibly; they must be in an enclosed garage. Overnight street parking is prohibited; vehicles must be garaged and garage doors kept closed. Temporary guest exceptions may be granted by the HOA.
- Assessments: Annual assessments are levied by the HOA, initially capped at $200 per lot. Special assessments require two-thirds owner approval. Assessments are a continuing lien on the lot and a personal obligation of the owner when due.
