It is not a community's full rulebook—it only covers fees and liens related to assured water supply. Property owners are bound by these covenants, which run with the land.
- Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD, based on the Parcel Replenishment Obligation (calculated from excess groundwater use). Interest, costs, and penalties apply if unpaid.
- Replenishment Reserve Fee: A one-time fee (equal to twice the Replenishment Reserve Charge multiplied by projected annual excess groundwater demand) must be paid by the owner to CAWCD before a public report authorizing sale/lease of subdivided lands. Long-term storage credits may be assigned in lieu of payment. Not applicable to Category 2 member land.
- Activation Fee: Each subdivision that qualifies as member land must pay an Activation Fee (set by CAWCD per housing unit) to CAWCD before a public report authorizing sale/lease of subdivided lands.
- Lien for Nonpayment: Unpaid Replenishment Assessments, Activation Fees, and Replenishment Reserve Fees create a continuing lien on the parcel and are a personal obligation of the owner at the time the fee came due. CAWCD has statutory remedies.
- Amendment Requirements: This declaration may be modified, amended, or revoked only (i) by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or (ii) by amendment of statutes, rules, or regulations.
