This document is NOT a full set of community rules—it is a partial, ancillary covenant that mandates a specific dispute resolution process between homeowners and the original builder (U.S. Home Corporation / Greystone Homes). It requires owners to follow a step-by-step process—notice, inspection, right to cure, mediation, and binding arbitration—before suing the builder over construction or warranty claims.
- What this document covers: It applies only to claims (construction defects, warranty disputes, personal injury or property damage related to the home) between an owner and the builder. It does not govern day-to-day living rules like pets, parking, or landscaping.
- Mandatory dispute resolution steps: Before any lawsuit, the owner must: (1) send a written Notice to the builder detailing the claim, (2) allow the builder at least 35 days to inspect, (3) give the builder at least 90 days to repair or pay, (4) attempt good-faith negotiation, and (5) mediate under AAA rules. Only then can binding arbitration be initiated.
- Binding arbitration requirement: If mediation fails, the claim must go to binding arbitration (not court) under AAA's Construction Arbitration Rules. For claims over $250,000 or demanding punitive damages, three arbitrators hear the case; otherwise one. The arbitrators must have relevant expertise.
- Builder's right to cure: The builder has the right to repair, replace, or pay for the defect within 90 days of receiving the Notice. The owner cannot sue until this cure period ends.
- Fees and costs: Each party pays its own mediation costs; the builder pays for one day of mediation fees. For arbitration, the filing party pays up to $750, and the builder pays the next $2,000 if the owner participated in mediation. Remaining fees are split equally.
- Scope of binding parties: The builder can include its parent companies, affiliates, contractors, and insurers in the mediation/arbitration. Claims involving those parties must also follow this process. Claims cannot be joined with other owners' claims without agreement.
- What this document doesn't cover: This document does not address HOA fees, assessments, leasing restrictions, pet limits, architectural guidelines, parking rules, or any other typical community regulations. It is solely a dispute resolution covenant between the builder and original or subsequent owners.
