What Gila Buttes's governing documents say
This is a partial set of records for the Gila Buttes community (Casa Grande, AZ). It contains two ancillary documents: a conservation easement (Restrictive Covenant) that permanently preserves certain common-area tracts as natural habitat, and a short annexation adding Phase 2 to the main declaration. These are not a full homeowners' rulebook — they do not cover typical topics like architectural rules, pet policies, or rental restrictions.
- Document type: The first document is a perpetual conservation easement granted to the U.S. Army Corps of Engineers requiring specific lots (Lots 1–279, Tracts AA–AZ, BA–BB in Phases 1 & 2) to remain in a natural condition for wetland mitigation. The second document simply annexes Gila Buttes Phase 2 land into the main Declaration.
- Conservation restrictions: The restricted property must stay in a 'Natural Condition' per a 2006 Mitigation Plan. Prohibited uses include: off-road vehicles, grazing, recreation (horseback riding, hiking, hunting/fishing), construction, dumping, excavating, altering topography, removing vegetation, using chemicals, and introducing non-native species. The Association (or subsequent owner) must perform long-term maintenance and signage.
- Enforcement & access: The Army Corps of Engineers has the right to inspect and enforce the covenant. If the Association violates the terms, the Corps can demand cure within 30 days and sue for injunction or restoration. The public has no general right of access to the restricted land.
- What this document doesn't cover: These documents do not contain rules for homeowner conduct, architectural review, pets, parking, leasing, assessments, or use of individual homes. Those rules would be in the main Declaration (CC&Rs), which is not provided here.
