Acacia Farms is a residential subdivision in Pinal County, AZ, subject to a water-supply covenant that secures a certified groundwater supply. This document creates a mandatory membership in the Central Arizona Groundwater Replenishment District (CAWCD) for all parcel owners. It requires payment of replenishment assessments, activation fees, and reserve fees, which become liens if unpaid. This is an ancillary document that does not contain typical HOA rules.
- Groundwater replenishment obligation: Each parcel is subject to a Parcel Replenishment Obligation based on groundwater use. CAWCD levies an annual Replenishment Assessment to fund replenishment of excess groundwater.
- Activation fee: An Activation Fee (set by CAWCD per housing unit) must be paid by the owner before the state real estate commissioner issues a public report authorizing sale or lease of subdivided land within the property.
- Replenishment reserve fee: A Replenishment Reserve Fee (twice the annual Replenishment Reserve Charge) must be paid before a public report is issued. Owners may assign long-term storage credits to CAWCD in lieu of cash payment. This fee does not apply to Category 2 member land.
- Lien for nonpayment: Unpaid Replenishment Assessments, Activation Fees, and Replenishment Reserve Fees become a continuing lien on the parcel and a personal obligation of the owner at the time the amount came due. CAWCD has statutory remedies for delinquency.
- Binding effect & amendments: This covenant runs with the land and binds all current and future owners. It can be amended only with the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property.
