What Desert Enclave's governing documents say
Desert Enclave is a single-family residential subdivision in Cave Creek, AZ governed by this Declaration of Covenants, Conditions and Restrictions (CC&Rs). It establishes a homeowners association (HOA) that all lot owners automatically join, and binds owners, occupants, and their guests. The rules cover use of lots, architectural control, assessments, and maintenance of common areas such as equestrian/pedestrian easements and street medians.
- Use restrictions (single-family residential): All lots are limited to single-family residential use. A 'single family' is defined as persons related by blood, marriage, or adoption, or a group of up to three unrelated persons living together as a household. No business, professional, commercial, religious, or institutional activities are allowed (except by the Association).
- Architectural control: Any exterior alteration, construction, landscaping, or grading requires prior written approval from the Design Review Committee. This includes changes to color schemes, fences, windows, awnings, antennas, satellite dishes, and temporary structures. No reflective window materials; drapes/curtains visible from outside must be white, off-white, beige, or natural wood-toned.
- Pets: Up to two dogs, cats, or other small household pets and up to two horses may be kept per lot without Board approval. Additional pets require Board approval. No breeding for commercial purposes; pets must not create unreasonable annoyance. Pets must be leashed or supervised when outside.
- Leasing & rentals: Owners may lease only the entire lot, for a minimum term of 30 days. Leases must be in writing, subject to the governing documents, and a copy provided to the Association within 10 days of signing. The Board may enforce lease violations if the owner fails to do so.
- Parking & vehicles: No trucks, boats, campers, trailers, or inoperable vehicles may be parked or stored on lots except inside garages. Garage doors must be kept closed except when in active use. No vehicle operation by unlicensed operators. Noisy vehicle operation may be deemed a nuisance.
- Assessments & fees: Annual assessments: initially $1,080 per lot ($90/month). After the first year, the board may increase up to 5% per year without a membership vote; larger increases require a majority vote of each membership class. Special assessments for capital improvements also require majority vote. Late payments accrue 12% annual interest. A working capital fund equal to two months of assessments is collected from each buyer at closing.
- Maintenance & compliance: The Association maintains the common areas (equestrian/pedestrian easement, street medians, and any other areas designated by the town or members). Owners must keep their lots free of weeds, trash, and debris. If an owner fails to maintain their lot or dwelling, the Association may enter and restore it after 30 days' notice, charging the owner for the cost.
- Easements & party walls: Blanket easements exist for the Association and Declarant to maintain improvements. Driveways located on lot boundaries are subject to shared exclusive-use easements for adjoining owners. No parking or standing vehicles on shared driveways.
