Estado de Cholla II is a single-family residential subdivision in Phoenix, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). The rules apply to all lot owners and future owners, but no homeowners' association or mandatory assessments are created by this document. Instead, the Declarant (developer) retains architectural control until it sells all lots or seven years elapse, and covenants may be enforced by any owner. Living here requires adherence to strict use, design, and maintenance standards.
- Single-family residential use: Each lot is limited to one single-family dwelling with a minimum of 2,500 livable square feet. No business, professional, commercial, or institutional use is allowed, though home offices are permitted.
- Architectural control: No exterior improvements, alterations, or landscaping may be made without prior written approval from the Declarant (so long as it owns any lot). Plans must be submitted for review, and approval is deemed granted if no decision is given within 30 days. The Declarant may charge a processing fee.
- Leasing & rentals: Only entire lots may be leased, and leases must be in writing for a minimum term of 30 days. Every lease must acknowledge that it is subject to the Declaration, and failure to comply constitutes a default.
- Pets: No more than three dogs, cats, or other small household pets per lot. Horses and large animals are prohibited. Pets may not be bred or kept for commercial purposes, and must not cause unreasonable annoyance.
- Vehicles & parking: Cars, trucks, boats, campers, and similar vehicles must be parked inside garages or screened areas not visible from neighboring properties. Inoperable vehicles or those in disrepair may not be stored. Garage doors must be kept closed except when in use, and garages cannot be converted to living space.
- Building & lot restrictions: Construction is only allowed within designated Building Envelopes, which cannot exceed 40% of the lot. Open Space and Desert Preservation Easements must remain undisturbed without approval. Fences and walls cannot exceed 8 feet and must be inside Building Envelopes. Setbacks are minimum 30 feet on sides and 40 feet front and rear.
- Duration & amendment: The covenants run for 20 years from the recording date (2004) and automatically renew for successive 10-year periods. Amendments require a written instrument signed by the Declarant and a majority (more than 50%) of lot owners.
