Capistrano I is a standard single-family homeowners association (HOA) in Chandler, AZ — you own your lot and house, and the association maintains common areas and enforces rules. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) is the governing rulebook for all owners, residents, and mortgagees.
- What you own & maintain: You own your lot and the residence on it; the association owns and maintains the Common Areas (e.g., landscaping, perimeter walls, rights-of-way). Owners have a non-exclusive easement to use the Common Areas.
- Membership & voting: Every lot owner is a member of the Capistrano I Homeowners Association. Each lot gets one vote (Class A). The builder holds Class B membership with three votes per lot until certain conditions are met (e.g., 120 days after Class A votes equal Class B, or 5 years after first lot sale).
- Assessments & common expenses: Each owner pays a proportional share of Common Expenses (fraction = 1 / total lots). Initial maximum annual assessment: $35. Owners must insure their own dwelling contents, personal property, and additional liability. - Property rights & easements: A blanket easement exists over Common Areas for utilities, ingress/egress, and emergency vehicles. A wall easement is created along perimeter boundaries. The board may grant exclusive use of minor Common Areas adjoining a lot.
- Board & management: The board manages the association and may hire a managing agent (contract term max 1 year, renewable). The builder appoints three board members while Class B memberships exist. Directors must be owners (or officers/partners/beneficiaries if corporate owned).
- Liens & foreclosure: Unpaid assessments become a lien on the lot, enforceable by judicial foreclosure. The lien is subordinate to first mortgages except for assessments accruing after the mortgagee takes possession. Owners can request a certificate of payment from the association.
