What Hamilton Homes Tempe's governing documents say
Hamilton Homes Tempe is a single-family residential subdivision in Tempe, AZ, governed by a homeowner's association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that apply to all lot owners. The HOA maintains common areas and enforces rules; each owner owns their lot and dwelling unit.
- Use restrictions: Lots must be used exclusively for single-family residential purposes. Minimum dwelling size is 1,750 square feet (exclusive of porches, garages). No businesses, hospitals, or similar uses are allowed.
- Architectural review: An Architectural Committee must approve all exterior construction, alterations, fences, landscaping, and painting. Plans are automatically approved if not disapproved within 30 days. The committee's decisions are final.
- Assessments & liens: The HOA levies annual and special assessments equally per lot. Unpaid assessments accrue 18% interest and become a lien on the lot, subordinate to first mortgages. The Declarant is exempt until all lots are sold.
- Maintenance responsibilities: The HOA maintains common areas (landscaping, etc.). Each owner must maintain their dwelling, lot, and all exterior surfaces. Garages must be kept neat, and garage doors shut when not in use.
- Parking & vehicles: Motor vehicles may only be parked in the garage or driveway on the owner's lot. No vehicle may remain in the driveway for over a week without written approval. Stored, abandoned, or infrequently used vehicles are prohibited.
- Pets & animals: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be kept in a fenced yard or on a leash. Cows, sheep, goats, and poultry are prohibited, except lots 73–82 may keep up to two horses if not prohibited by city zoning.
- Fences & walls: Perimeter fences must be block or wrought iron (or combination). Solid walls or fences cannot exceed 6 feet in height; no solid wall, fence, or hedge over 3 feet within 25 feet of the front lot line.
