Sunburst Farms Tempe is a single-family residential subdivision in Tempe, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) originally recorded in 1973. These rules apply to all lot owners and are designed to protect property values by controlling land use, building design, and lot maintenance.
- Land use & building type: All lots are for single-family residential use only. No building may be used as a residence except a single-family dwelling, a private garage/carport, and a stable/livestock shelter. Servant or guest quarters must be part of the main residence.
- Architectural review: An Architectural Control Committee (initially Henry F. Kaestner, R. Crawford Logan, A. J. Bryant) must approve plans for any building, fence, or alteration before construction. Approval is in writing; if no response within 30 days, approval is deemed given.
- Setbacks & lot coverage: The main building and accessory buildings cannot cover more than 30% of the lot. Front setback: 35 feet (porch/garage may project 5 feet). Side setbacks: 15 feet. Rear setback: 30 feet (measured from center line of a 16-foot alley if applicable). Maximum building height: two stories or 30 feet.
- Minimum floor area: The main structure's ground floor area (excluding open porches, pergolas, garages) must be at least 800 sq ft for a one-story dwelling, or 600 sq ft for a dwelling of more than one story.
- Pets & livestock: Horses, poultry, and livestock may be kept for personal use only, with no more than two horses per lot. Swine are prohibited. All animal areas must be fenced with steel posts set in concrete or masonry, and maintained in a clean, non-nuisance condition. Commercial animal husbandry is forbidden.
- Fences & walls: No solid fence or wall over 3 feet high may be placed nearer than the front building line (or 35 feet if no residence exists). Side and rear fences/walls may be up to 6 feet high. Certain lots (68-74) require a chain-link fence at least 4 feet high along the south property line. Hedges over 3 feet are prohibited within 35 feet of the front property line.
- Vehicles & storage: Abandoned or inoperable vehicles must not be visible from other lots or streets. No trailers, tents, or temporary structures may be used as residences. No commercial signs larger than 5 sq ft allowed, except one 'for sale' sign.
- Easements & maintenance: Utility and drainage easements are reserved; no structures or plantings may obstruct them. A bridle path easement benefits all owners, but maintenance is the responsibility of each lot owner. Motor vehicles (except maintenance/emergency) are prohibited on bridle paths.
