This is a Declaration of Covenants, Conditions, Easements and Restrictions for Chandler Piazza, a commercial mixed-use development in Chandler, AZ (office, hotel, retail, restaurant, and business complex). It governs the owners of eight separate lots (Lots 1–8) and the common area, and applies to any person acquiring an interest in the project. The rules bind lot owners and their occupants, lessees, and permittees.
- Use restrictions & permitted uses: Only Lot 5 may be used for a hotel, motel, or conference center; that restriction automatically terminates if the hotel ceases use for 60 days. Prohibited uses on all lots include convenience stores, car washes, warehouses, theaters, self-storage, pawn shops, adult entertainment, industrial or residential uses, and many others. The project must initially include at least two 'sit-down' casual or fine dining restaurants (e.g., Outback, PF Chang's), and fast-food restaurants are restricted near Lot 5 while it operates as a hotel.
- Architectural review (ARC): All exterior improvements visible from outside a building require prior written approval by the Architectural Review Committee (ARC). The initial review fee is $500, and the owner pays all additional costs. - Building height limits: The maximum height for each lot (measured from pre-construction natural grade): Lot 1: 1 story / 22 ft; Lot 2: 1 story / 22 ft; Lot 3: 1 story / 22 ft; Lot 4: 1 story / 22 ft; Lot 5: 4 stories / 59 ft; Lot 6: 1 story / 22 ft; Lot 7: 1 story / 22 ft; Lot 8: 3 stories / 45 ft.
- Parking & easements: Each lot must provide parking meeting minimum governmental requirements. Overflow parking easements exist among retail/restaurant parcels (Lots 1–4, 6, 7) but not on Lots 5 and 8. Lot 5 has a designated overflow parking area on Lot 8 while the hotel operates. Owners must restrict their permittees from parking on other owners' lots and may enforce towing. The common area is restricted to landscaping and signage.
- Maintenance responsibilities: The Association maintains all common areas. Each lot owner must maintain their lot, including all improvements, traffic areas (driveways, walkways, parking), landscaping, lighting, and signage, in good condition and in keeping with the upscale character of the project. If an owner fails to maintain, the Association may perform the work and charge the owner as a special assessment.
- Lighting requirements: Each owner must fully illuminate their lot's traffic areas from dusk to at least 11:00 p.m. (or as prescribed by the ARC) and provide low-level security lighting until dawn. Exterior building security lights must remain on from dusk until dawn. Average exterior lighting output cannot exceed 3 foot-candles without ARC approval.
