Haciendas is a single-family home subdivision in Chandler, AZ, governed by a homeowners association (HOA). These Covenants, Conditions & Restrictions (CC&Rs) apply to all lot owners and residents, setting rules for property use, appearance, and assessments.
- Use restrictions: Lots are for single-family residential use only. No business, professional, commercial, rest home, religious, or institutional activities are allowed. No noxious or offensive activities or nuisances are permitted.
- Architectural review: All buildings, fences, walls, and other structures require prior approval of the Board of Directors, including plans and specifications. Exterior changes (paint, additions, etc.) also need approval. Failure to reject within 30 days constitutes approval.
- Parking & vehicles: Trucks, vans, trailers, boats, campers, and inoperable vehicles must be parked in garages (with doors closed) unless Board approves otherwise. Overnight parking is allowed only in the designated pool area. Parking on grass, gravel, or bricks in front of homes is prohibited.
- Pets: Up to two commonly accepted household pets are allowed, but not for commercial breeding or keeping. Other animals require written permission from the Board. Animals running loose may be removed by the Association.
- Party walls: Walls built on lot dividing lines are party walls. Repair costs are shared equally unless damage is caused by one owner (who then pays). Rebuilding after damage requires adjoining owner and Board consent. Disputes go to Board arbitration.
- Common areas: Tracts A, B, and C include private roads (Tract A) and park/recreational facilities (Tracts B and C). Members have an easement to use common areas, subject to Board rules. The Association maintains these areas via assessments.
- Assessments: Annual and special assessments are levied uniformly per lot. Assessments are a lien on the property and bear 8% interest if delinquent. The Association can foreclose on a lot for unpaid assessments.
