What Butterfield Park V Homeowners' Association's governing documents say
Butterfield Park V is a 44-unit condominium (horizontal property regime) in Phoenix, AZ, established in 1981. Owners own their individual units and share ownership of common elements through the Butterfield Park V Homeowners' Association.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings) and are responsible for all maintenance, repairs, and decorating inside, including windows, doors, and utility lines serving only your unit. The association maintains the common elements (buildings, grounds, shared utilities) funded by common expenses.
- Assessments & fees: Each owner pays a proportionate share of common expenses (based on the unit's percentage interest in the common elements). Unpaid assessments become a lien on the unit, subordinate only to first mortgages or deeds of trust. The board can levy special assessments for repairs or deficiencies.
- Pets: Dogs, cats, or other household pets may be kept in a unit with association approval, but no animals may be raised, bred, or maintained for commercial purposes. No other animals are allowed.
- Parking & vehicles: The board assigns at least one parking space per unit. Boats, campers, and vehicles other than passenger automobiles and motorcycles may not be parked or stored without association permission. No vehicle repairs on the property.
- Right of first refusal: Before selling a unit, the owner must notify the association, which has 15 days to match the offer and purchase the unit on the same terms. This right does not apply to foreclosure or trustee's sales.
- Architectural control & alterations: Non-structural alterations inside a unit do not require approval, but the owner is liable for any resulting damage. Structural changes or any alteration to common elements, patios, or balconies require prior board or majority owner approval, including submission of plans and a possible review fee.
- Insurance: The association carries master property insurance (fire and other hazards) covering common elements and units (excluding owner improvements and contents), plus liability insurance for common elements. Owners should insure their own possessions and improvements. Premiums are common expenses.
- Use restrictions: Units must be used for residential purposes only. No signs, commercial operations, nuisances, or activities that increase insurance rates are allowed. Owners must comply with all laws and association rules.
