Kempton Crossing is a single-family residential community in Chandler, AZ where you own your individual lot and home outright as a separate freehold estate. The HOA maintains common areas and enforces strict architectural and use standards across the community.
- What you own & maintain: You own your lot and home outright; the association maintains the common areas. You must maintain your lot's landscaping in good condition, keep lawns mowed and trimmed, remove debris and dead plants, and install acceptable street-visible landscaping within 180 days of purchase.
- Architectural review & exterior changes: Any exterior alteration, color change, addition, or improvement requires written Architectural Committee approval before work begins. The committee has 45 days to respond (automatic approval if silent); it can refuse approval for aesthetic or other reasons. Even detached garages, gazebos, and guest quarters require approval.
- Assessments & fees: Annual assessments start at $300 per lot through December 31, 1999, then automatically increase yearly by the greater of 5% or the Consumer Price Index, plus utility or insurance increases. Initial purchasers pay a one-time capital reserve fee of 1/6 the annual assessment (non-refundable); later buyers pay a transfer fee set by the board. Late payments incur 12% annual interest, and unpaid assessments can result in liens and foreclosure.
- Leasing & rentals: You may lease your home, but the minimum lease term is 30 days (no short-term or vacation rentals). A copy of the lease must be provided to the association, and the lease must require the tenant to abide by the Declaration and HOA rules.
- Pets: A reasonable number of generally recognized house or yard pets are allowed for domestic use only, not commercial purposes. Pets cannot create unreasonable noise or nuisance. No structures for animal housing or care may be visible from neighboring property.
- Vehicles & parking: Vehicles over one ton are prohibited. Pickup trucks ≤1 ton or mini motor homes ≤7 feet high and ≤18 feet long may be parked in garages or driveways only if used regularly for basic transportation. No vehicle repairs are permitted except in emergencies. Guest vehicles may park on-street for a maximum of 12 consecutive hours within any 48-hour period. Boats, trailers, recreational vehicles, and aircraft are prohibited.
- Party walls & fences: If your lot shares a party wall or fence with a neighbor, both owners have equal rights to use it. If you damage it through your actions, you must repair it at your expense. If damaged otherwise (including normal wear), you and adjoining owners split repair costs in proportion to your lot's frontage on the wall or fence.
