What Lynn Haven Estates's governing documents say
Lynn Haven Estates is a single-family home HOA in Phoenix, AZ. You own your lot and house; the association maintains common areas and enforces rules through an architectural committee and board. This document binds all owners, residents, and tenants.
- Architectural review: Prior written approval required for any exterior change, including landscaping, paint, additions, fences, and signs. The Architectural Committee has broad discretion and may charge a review fee. Approval not needed for Declarant's work.
- Home businesses: Home businesses allowed only if no external visibility or detectability, no customer visits, no non-resident employees, and no impact on residential character. Leasing a unit is not considered a business.
- Pets: Up to 2 domestic pets (dogs, cats, birds) per lot. Dogs must be leashed (max 6 feet) on common areas; owners must remove feces. Board may further restrict or remove dangerous or nuisance pets.
- Parking & vehicles: Vehicles must be parked in garage; if insufficient, driveway parking allowed for vehicles ≤7 ft tall and ≤18 ft long, no commercial signage. Recreational vehicles limited to 24 consecutive hours or 72 hours in 7 days. No inoperable or stored vehicles visible; Board may tow violators.
- Leasing & rentals: Leases must be for at least one month initial term; no subleasing. Owner must provide tenant names, lease dates, and emergency contact 10 days before lease begins. Owner is liable for tenant violations.
- Assessments & fees: Annual assessments levied equally per lot; special assessments require 2/3 vote of members (plus Declarant approval if Declarant owns a lot). Unpaid assessments create a lien and incur interest and late fees.
- Common area use: Owners and residents have an easement to use common areas, subject to Board rules. Access may be suspended for delinquent assessments or uncured violations.
