What Stellar City Airpark's governing documents say
This is an easement and restrictive covenant document for a portion of Stellar City Airpark, a residential airpark community in Scottsdale, AZ. It grants a non-exclusive easement for aircraft taxiing over a shared taxiway (Tract H) and imposes use and building restrictions on the adjacent Benefitted Property (Tract B). This is an ancillary document binding specific landowners, not a full HOA declaration for the entire airpark.
- Easement for aircraft access: The owners of Tract H grant a perpetual, non-exclusive easement to the owner of the Benefitted Property (and later to lots created from it) to taxi and operate aircraft across Tract H to access the Stellar Airport runway.
- Maintenance cost sharing for taxiway: Initially, the owner of the Benefitted Property pays 8/13ths and each Tract H owner pays 1/13th of the costs to maintain, repair, and replace Tract H. After subdivision, costs are split equally among Tract H owners and owners of lots adjoining Tract H (e.g., 1/13th each if 8 lots are created).
- Permitted use & subdivision: The Benefitted Property may only be used for residential purposes unless all Tract H owners approve another use. It may be subdivided into a maximum of 8 lots, each with one single-family residence (minimum 1,800 sq ft) plus attached carport/garage and sheltered aircraft parking. Guest houses or servants quarters are allowed if attached and at least 500 sq ft, and cannot be rented.
- Building & fence restrictions: Minimum front setback: 20 feet from front property line. Side setbacks: 7 feet from interior side lot lines, 20 feet from side streets. Fences: no taller than 6 feet behind the front of the residence, and no taller than 3 feet in front of the residence or running outward to the street.
- Pets & livestock: No poultry, cattle, pigs, horses, rabbits, or livestock. Usual domestic pets (dogs/cats) are allowed but must be confined to the owner's premises by leash or enclosure.
- Noise & nuisance restrictions: Noises must be minimized; aircraft engine running or testing is prohibited after 9:00 PM and before 8:00 AM. Rubbish, dismantled equipment, and obnoxious odors are prohibited.
- Prohibited structures & uses: No temporary buildings (except during construction), trailers, or storage tanks above ground (except buried or screened propane/butane). No antennas visible from outside; must be concealed. No commercial enterprises (stores, hospitals, hotels, etc.). No part of a residence can be used for living until the entire structure is complete.
- What this document does not cover: This document does not establish a homeowners association, set dues or assessments for the entire airpark, or contain rules common to the broader Stellar City Airpark community (such as architectural review for all lots, common area rules, or enforcement procedures beyond this easement).
