It establishes the homeowners association, sets rules for all lots, and binds all owners and their tenants. The document covers permitted uses, architectural controls, assessment obligations, and common area rights.
- Leasing & rentals: No lease for a term of less than six months. Owners must notify the association of any lease and provide the term and lessee name. All leases must comply with all project documents.
- Pets & animals: Only a reasonable number of generally recognized house or yard pets allowed, kept as domestic pets (not commercial). Pets must be restrained by fence, cage, or leash at all times and not become a nuisance. Animal structures must not be visible from neighboring property.
- Architectural review: No exterior improvements, alterations, landscaping (except initial) or changes may be made without prior written approval from the Architectural Committee. This includes buildings, fences, walls, antennas, satellite dishes, roof-mounted equipment, and any change in exterior appearance.
- Parking & vehicles: No motor vehicles exceeding 3/4-ton rating, mobile homes, travel trailers, boats, or similar equipment may be parked where visible from neighboring property. Pickup trucks (≤3/4-ton) with camper shells ≤7 ft high and mini-motor homes ≤7 ft high and ≤18 ft long used for regular transportation are exempt.
- Assessments & fees: Annual assessments levied per lot; initially $264 per year. Board may increase annually by CPI or 5% (whichever greater) without vote; larger increases require 2/3 member vote. Supplemental assessments (if funds inadequate) also require 2/3 vote. Special assessments for capital improvements require 2/3 vote. Assessments become a lien if unpaid after 15 days, with late fees and attorney's fees. First mortgage liens are subordinate to assessment liens.
- Use restrictions: All lots are for single-family residential use only. No business, trade, or nonresidential use allowed. No temporary residences (trailers, tents, etc.). No nuisance, no exterior sound devices except security. No subdivision of lots. Signs limited to one 'For Sale' or 'For Rent' sign per lot, size determined by Architectural Committee.
