What Biagio Condominiums's governing documents say
Biagio Condominiums is a 116-unit condominium community in Phoenix, AZ. You own your individual unit and an equal share of the common elements. The association maintains common areas and carries master insurance, funded by per-unit assessments. Leasing is permitted only for terms of three consecutive months or longer, and must be of the entire unit.
- Leasing & rentals: Leases must be for at least three consecutive full calendar months (no transient/hotel use). You cannot lease less than your entire unit. All leases must be in writing and subject to the governing documents; the association must be notified of lease start/end dates and occupant names.
- Pets: No more than two dogs per unit, each dog under 40 pounds (except service animals). Pets must be leashed (max 6 feet) outside the unit and not relieve themselves on common elements. The board may further restrict breeds, size, or number.
- Parking & vehicles: Vehicles must be parked in your unit's garage or driveway first. Commercial vehicles, RVs, boats, etc. are prohibited except in the garage. No parking on interior roadways; a 20-foot fire lane must be clear. No vehicle repair or storage of inoperable vehicles outside the garage.
- Use restrictions & business: Units are for single-family residential use only. Home businesses are allowed if not visible or audible from outside, no customer visits, and no more than one non-resident employee. No nuisance or offensive activity is permitted.
- Architectural review & exterior changes: Structural additions or alterations require prior board approval and a licensed engineer's certification. Any change visible from outside (including window coverings, paint, or patio modifications) also needs board approval. No exterior antennas, satellite dishes, or clotheslines without approval.
- Assessments: Annual common expense assessments are set by the board, initially capped at $2,400 per unit per year, increasing annually by up to 10% or CPI. Special assessments require a two-thirds member vote if exceeding the cap. Assessments are equal per unit (1/116 each).
- Maintenance responsibilities: The association maintains all common elements (exteriors, roofs, landscaping, pools, etc.). Unit owners maintain their unit interior, limited common elements (patios, balconies, garage doors, windows, and HVAC/water heaters), and must keep patios/balconies neat and free of storage.
- Variances: The board may grant variances from any rule if hardship or aesthetic/environmental reasons justify it. Variances must be in writing and signed by a majority of the board; they may be temporary or conditional.
