San Marcos Fairways is a single-family residential subdivision in Chandler, AZ, governed by a Homeowners Association (HOA). This Declaration of Covenants, Conditions, Restrictions and Easements sets rules for all lot owners, residents, and lessees. The HOA manages common areas and private drives, and enforces architectural and use restrictions to maintain the neighborhood's character.
- Architectural review & approval: All exterior alterations, new construction, landscaping, and color changes require prior written approval from the Architectural Control Committee. No outdoor incinerators allowed.
- Single-family use & building limits: Lots are for single-family residential use only; no business activities. Only one dwelling per lot, minimum 1,800 sq ft (1,600 sq ft for zero-lot-line homes), with attached garage or carport. No outbuildings. Building height cannot exceed 24 feet and must not unreasonably obstruct neighboring views of the golf course fairways.
- Assessments & HOA fees: Each lot owner pays an annual assessment set by the HOA board, currently capped at $100 per lot per year unless increased by a two-thirds vote of members. Assessments are due within 10 days of invoice; unpaid amounts become a lien, enforceable via materialman's lien foreclosure.
- HOA membership & enforcement: One membership per lot, non-transferable except with sale. Violations may be enforced through legal action, with violators liable for attorney's fees if the HOA prevails.
