What Delrossoa's governing documents say
This is a commercial shopping center governing document for Delrossa in Chandler, AZ. It applies to owners and occupants of multiple parcels (a major parcel and outparcels) that form an integrated retail shopping center, not a residential community. The document sets reciprocal easements, use restrictions, construction standards, and maintenance obligations for the benefit of all parcels.
- Permitted & prohibited uses: Only retail sales, offices, restaurants, and other commercial uses allowed by Chandler zoning are permitted. Prohibited uses include residential, automotive sales/repair, movie theaters, bars with over 30% alcohol revenue, pawn shops, arcades, churches, hospitals, hotels, and many others. Certain uses require Major Parcel Owner approval; others are automatically allowed (see Exhibits F and G).
- Easements & common area: Each parcel grants non-exclusive easements to other parcels for ingress/egress, parking, pedestrian access, and utilities over the common areas (driveways, parking, sidewalks). The Major Parcel Owner constructs and maintains the common area, including lighting, landscaping, signage, and utility lines, and Outparcel Owners pay their pro rata share of costs plus a 10% management fee.
- Parking requirements: Each outparcel must independently provide at least 5.5 parking spaces per 1,000 sq ft of floor area, and no fewer than shown on the site plan. No outparcel owner may restrict parking (e.g., reserved spaces) without Major Parcel Owner consent. Employees must park on their own outparcel.
- Construction & design: All construction must comply with government regulations and the architectural theme (Exhibit C). Buildings cannot exceed one story or height restrictions. Outparcel owners must submit plans for approval by the Major Parcel Owner at least 90 days before construction. No material deviation from approved plans is allowed.
- Signage: Pylon signs are allowed only in designated locations and must conform to sign criteria (Exhibit D). The Major Parcel Owner controls top 67% of primary pylon signs; one outparcel owner may use lower 33%. Building signs are limited to business identification and must comply with all regulations. No other freestanding signs are permitted.
- Maintenance obligations: The Major Parcel Owner maintains common areas (paving, landscaping, lighting, utility lines) and Outparcel Owners reimburse proportionate costs. Each outparcel owner must maintain its building exteriors in first-class condition and store trash in concealed containers. Damage to common areas or buildings must be repaired promptly at the owner's expense.
- Insurance & indemnification: Each owner must maintain commercial general liability insurance for its parcel. Owners indemnify each other for claims arising from hazardous materials, construction activities, or property damage caused by their operations.
- Leasing & transfer restrictions: No residential use is permitted. Any change in use requires Major Parcel Owner approval (not to be unreasonably withheld except for prohibited uses). There is no minimum lease term mentioned, but the document does not apply to residential tenants.
