What Capriana's governing documents say
Capriana is a single-family home subdivision in Chandler, AZ, governed by a homeowners' association. This declaration binds all lot owners to a set of covenants, conditions, and restrictions designed to maintain property values and community standards.
- Single-family residential use: Each lot may only be used for single-family residential purposes. No business or trade is allowed on a lot unless it is not detectable from the exterior, conforms to zoning, and does not increase HOA insurance or create a nuisance.
- Leasing & rentals: Leases must be for the entire lot, for a minimum rental period of 30 days. No transient or hotel use is permitted. A copy of the lease must be provided to the association before occupancy.
- Pets: Only customary household pets (dogs, cats, household birds) are allowed, and in reasonable numbers that do not create a nuisance. Animal waste must be promptly disposed of. The board can determine if a pet is a nuisance or if the number is excessive.
- Assessments & fees: Annual assessments start at $324 per year ($27/month) and may increase annually by 5% or CPI, whichever is greater. Special assessments may be levied with a two-thirds vote of Class A members and Declarant vote (while Class B exists). A working capital fee equal to one-sixth of the current annual assessment is due from initial purchasers.
- Architectural review: All exterior improvements (structures, landscaping, fences, solar collectors, antennas, satellite dishes, changes in grade) require prior written approval from the Architectural Control Committee. Houses must have at least 1,500 square feet of livable space, exclusive of porch, garage, etc.
- Vehicles & parking: Commercial vehicles and recreational vehicles (campers, boats, trailers) may not be parked where visible from the street or other lots for more than 4 consecutive hours. No inoperative or abandoned vehicles may be stored visibly. Major repairs are limited to inside an enclosed garage.
- Landscaping & maintenance: Landscaping must be installed within 60 days of closing and maintained in a neat and attractive manner. Grading, slopes, retaining walls, and drainage must be preserved. The association may perform landscaping work at the owner's expense after 15 days' notice of default.
- Fences & party walls: All fences must be cement block construction and approved by the committee. Side or rear fences may be up to 6 feet high. Fences between lots are party walls, maintained and repaired jointly by adjoining owners. Damage caused by one owner must be repaired by that owner.
