What Chandler Heigh's governing documents say
This document is a shared well agreement among the owners of four specific parcels (401-14-035a through d) in Pinal County, AZ, rather than a full community association rulebook. It governs only the private domestic water well serving those four properties. Owners of those parcels automatically become shareholders in the well system by signing, and the rules apply equally to all four.
- Well ownership & shares: There are exactly four indivisible shares, one per property. A share cannot be transferred separately from the property. An owner must sign the agreement to obtain a share and gain rights to water.
- Water use restrictions: Water may only be used for reasonable domestic purposes on the owner's own property. If demand exceeds well capacity, each shareholder gets an equal share of the maximum current production.
- Cost sharing & meters: Shareholders pay equal shares of all operation, maintenance, repair, replacement, and expansion costs. Utility charges are paid proportionally based on metered usage. Each shareholder must install and maintain a meter at their own expense; failure results in loss of water rights.
- Easements & access: An easement in gross benefits all shareholders for pipeline access to the well site. It must be exercised to minimize interference with improvements and landscaping. The easement cannot prevent placing a residence as long as reasonable heavy equipment access remains.
- Decision-making & rule changes: A majority of shareholders makes management decisions (e.g., deposits, hookup fees). Any modification or repair of the well system requires written consent of 75% of shareholders, except in emergencies. Operating and capital improvement accounts may be established; capital expenditures need 75% approval.
- Dispute resolution: Disputes affecting water reliability, safety, or funding are submitted to arbitration. If parties cannot agree on an arbitrator, any shareholder may request the Arizona Department of Water Resources director or a state official to appoint one. The arbitrator decides who bears costs. The prevailing party may recover reasonable attorney fees.
- Defaults & termination: If a shareholder breaches the agreement and does not cure within 60 days of written notice, a majority of the remaining parties may record a notice terminating that party's interest, including easement and water rights.
