What Superstition Ranch's governing documents say
Superstition Ranch is a master-planned, single-family home community in Chandler, AZ, governed by the Superstition Ranch Community Association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land and bind all owners. It covers assessments, use restrictions, architectural control, and association powers.
- Assessments & fees: Annual assessments start at $30 per lot in the first year and increase automatically by the greater of 5% or the CPI. Special assessments require approval of Declarant (while Class B membership exists) and 2/3 of Class A members. Late payments incur 12% interest and up to 25% late charge. Declarant and developers pay only 25% of the annual assessment.
- Membership & voting: Each lot owner is a member with one vote per lot. Tenants have no voting rights. Declarant holds Class B membership with 3 votes per lot until conversion to Class A (when Class A votes equal Class B votes, or by Dec 31, 1997). Quorum for meetings is 60% of votes; if unmet, subsequent meeting quorum is half.
- Architectural review: An Architectural Control Committee is established and may adopt guidelines. All improvements require committee approval to ensure consistency with the master plan.
- Common area maintenance & insurance: The association maintains common areas, including landscaping and decorative walls. It must carry at least $1,000,000 liability insurance and replacement-cost property insurance on common improvements. Owners can delegate use of common areas to tenants residing in the project.
- Land use & lot development: The project is for single-family detached and attached dwellings. The maximum number of lots that can be annexed from the Annexable Property is 438. Developers must obtain Declarant's consent for plats and rezoning. Subsidiary associations may be formed for neighborhoods.
