This document is a supplemental Declaration that binds all property owners to pay mandatory fees and assessments to the Central Arizona Groundwater Replenishment District (CAWCD) for groundwater replenishment. It does not establish typical HOA rules; it solely governs water-related financial obligations.
- Groundwater replenishment assessment: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD based on the Parcel Replenishment Obligation. Unpaid assessments become a lien on the property and a personal obligation of the owner.
- Activation fee: An Activation Fee, set by CAWCD per housing unit, must be paid by the owner before the sale or lease of subdivided lots within the property. The fee funds water supply and infrastructure costs.
- Replenishment reserve fee: For Category 1 member land, a Replenishment Reserve Fee is due prior to issuance of a public report for sale or lease, based on projected Excess Groundwater demand. Owners may assign long-term storage credits instead of cash payment. Category 2 parcels are exempt.
