What Ware Farms's governing documents say
Ware Farms is a master-planned development in Coolidge, AZ. The documents recorded are not the community's HOA rules for residents. Instead, they impose (1) groundwater replenishment fees and membership obligations that run with the land, and (2) builder covenants and a right of first refusal that bind the developer, not individual homeowners after they buy a completed home. These documents affect the property's title and development process but do not regulate daily living.
- Groundwater replenishment fees: Every parcel in Ware Farms is subject to annual Replenishment Assessments, an Activation Fee, a Replenishment Reserve Fee, Annual Membership Dues, and an Enrollment Fee, all set by the Central Arizona Water Conservation District (CAWCD). These fees are due to CAWCD and create a lien on the parcel if unpaid.
- Right of first refusal: The original seller (Pantano Ware LLC) has a right of first refusal on any sale of the property by the developer (BHEG Ware Farms LLC) for up to 10 years from recording. However, this right does not apply to: retail home sales to individual buyers, foreclosure, transfers to affiliates, or transfers to approved homebuilders under certain size restrictions.
- Builder construction obligations: The developer must comply with detailed construction obligations including soil compaction, utility hook-ups, impact fees, insurance, and indemnity. These obligations apply only to the developer and are not binding on individual homeowners after a retail sale.
