This is a supplemental covenant recorded for the Santa Cruz Village community in Eloy, AZ. It requires all property owners to pay certain fees to the Central Arizona Groundwater Replenishment District (CAWCD) to secure a certificate of assured water supply. It is not a typical HOA declaration and does not govern day-to-day living rules.
- Groundwater replenishment fees: Each parcel is subject to a Replenishment Assessment (annual) based on excess groundwater use, an Activation Fee (paid once before sale/lease), and a Replenishment Reserve Fee (for Category 1 member land). Amounts are set by CAWCD.
- Lien for unpaid fees: Unpaid Replenishment Assessments, Activation Fees, and Reserve Fees become a continuing lien on the parcel and are also a personal obligation of the owner at the time they came due. CAWCD has remedies under Arizona law.
- Binding on all owners: Every owner of a parcel in Santa Cruz Village is automatically bound by this declaration when they acquire title. The covenants run with the land and bind successors.
