What Crestview Homeowners Association's governing documents say
Crestview Homeowners Association is a single-family planned community in Yavapai County, Arizona, governed by these bylaws (amended 2015) and Arizona state law. You own your individual lot and share ownership of common areas; the elected board manages the community and enforces the governing documents. This document covers governance structure, member rights, and how the association operates.
- What you own & maintain: You own your individual lot; the association owns and maintains common areas. The Architectural Control Committee must approve any alterations or improvements to your property.
- Assessments & late fees: Annual and special assessments are levied per lot and cannot increase more than 20% per year without member approval. Late payments (15+ days overdue) incur a charge of the greater of $15 or 10% of the unpaid amount; if not paid within 30 days of delinquency, interest accrues at 18% per year. The association can foreclose on your property for unpaid assessments, and you cannot escape liability by abandonment.
- Board & governance: A Board of Directors (3–7 members, elected for 2-year terms) manages the association. The annual meeting is held in January; members elect directors and vote on major decisions. Only one household member can serve on the board at a time, and directors receive no compensation but are reimbursed for expenses.
- Member meetings & voting: Annual membership meetings are required; special meetings can be called by 25% of members. Quorum is 1/4 of members. All meetings are open to members, who may attend, speak, and vote in person or by absentee ballot. Members can audio/videotape open sessions. Board must provide 48 hours' notice of board meetings (after declarant control ends) and 10–50 days' notice for member meetings.
- Records & transparency: Members can inspect association financial and other records during business hours; the association has 10 business days to fulfill requests. Copies cost up to $0.15 per page. Some records may be withheld (attorney communications, pending litigation, personal/employee information).
- Violations & enforcement: The board can impose reasonable monetary penalties for rule violations after notice and an opportunity to be heard. Members have 21 days to respond to violation notices in writing and may request an administrative hearing with the state real estate department.
- Resale disclosure: When selling, the seller or association must provide the buyer with bylaws, declaration, operating budget, reserve study, and a statement of assessments and reserve amounts within 10 days. The association can charge up to $400 for resale documents plus up to $100 for rush service. The buyer must sign an acknowledgment that they understand the CC&Rs and that unpaid assessments can result in a lien on the property.
